John New, 26, and Tara New, 26, were charged with receiving and distributing child pornography between January 5 and March 17.
The Southwest Missouri Cyber Crimes Task Force received a tip that child pornography was going through an IP address and traced it to the News' Hollister home.
On March 16, 2020, this affiant applied for and received a search warrant for 151 White River Mountain Boulevard from United States Chief Magistrate Judge David P. Rush.
On March 17, 2020, this affiant, HSI, and the SMCCTF executed the search warrant. Upon arrival contact was made with John New (hereinafter “John”) and Tara New (hereinafter “Tara”). Inside the residence was also John and Tara’s two-year-old minor child.
This affiant asked John if he would be willing to speak with himself and Federal Bureau of Investigation (FBI) and SMCCTF TFO Charles Root, and John agreed that he would. This affiant escorted John to his vehicle and placed John in the front passenger seat.
TFO Root advised John of his rights per Miranda, which John stated he understood and agreed to waive to speak with the affiant. John was provided a copy of the search warrant and given time to read it.
Post-Miranda, in a recorded interview, John said he would just make it easier and tell law enforcement where the child pornography was. John stated the child pornography was on an external hard-drive in two folders, both were labeled “Siberian mouse.”
John stated he obtained the child pornography through UTorrent, a P2P network. John admitted that he masturbated while watching the child pornography. John further admitted that Tara also viewed the child pornography and she would masturbate him while they watched.
John stated they watched the child pornography from their T.V. monitor in the living room, which was connected to their desktop computer. John said he built the desktop computer. John said he had been viewing child pornography for approximately two years.
HSI Special Agent (SA) Ken Killian made contact with Tara and asked if she would be willing to speak with him in his vehicle. Tara agreed that she would and SA Killian escorted Tara to his vehicle where she sat in the front passenger seat.
At this time, SA Killian was interviewing Tara as a witness; however, during the course of the interview Tara made incriminating statements. After the interview was complete, SA Killian re-contacted Tara inside the home and asked her if she would speak with him again.
Tara agreed that she would and the two went back to SA Killian’s vehicle. SA Killian advised Tara of her rights per Miranda, which she stated she understood and agreed to waive to speak with SA Killian.
Post-Miranda, in a recorded interview, Tara stated that she and her husband, John, used to watch adult pornography together. Later John suggested they watch child pornography together, and approximately a year ago, the two started to watch child pornography together.
Tara stated that while they would watch the child pornography she would masturbate John.
Tara stated they would watch the child pornography on their desktop computer. Tara stated the child pornography files were contained within a specific folder on the computer. Tara also admitted they both knew and talked about how what they were doing was illegal.
Law enforcement seized multiple devices from the residence including a desktop computer, a laptop computer, external hard drives, several SD cards, and a digital camera. On scene, a forensic preview located two hidden folders on an external hard drive sitting next to the custombuilt desktop computer. Within the hidden files, law enforcement located multiple videos of child pornography.
